It will be Possible to Regulate Issue of Notifications of Participants in Administrative Proceedings with Adoption of Draft

The draft law on Making Amendments and Addenda to the Law on Fundamentals of Administration and Administrative Proceedings authored by the deputies of the NA Civil Contract Faction Gevorg Papoyan and Mikayel Tumasyan defines that in cases where it is not possible to notify the participant in administrative proceedings in person or by registered mail, with a return notification, finally, it will be possible to post a notification on the official website of public notifications of the Republic of Armenia.

As a result of the adoption of the draft, the issue of notifications of the participants in administrative proceedings will be regulated by the administrative bodies. To this end, a provision is set, according to which, it is also envisaged to post the notification on the official website of public notifications of the Republic of Armenia simultaneously with the notification of individuals and legal entities, where the person will be considered properly notified on the fifth calendar day following the day of posting the notification. “We try to solve the problems with this draft and not to allow illegality to rule, not to allow the citizens to not fulfill their obligations to the state and society,” Gevorg Papoyan said, referring to the behavior of the citizens who try to make use of gaps of the law and not to be notified.

A reduction of expenditures is envisaged in the budget of the state or local-self government body with the adoption of the draft. In particular, costs envisaged for notifications and used office supplies will be reduced.

Gevorg Papoyan informed that the Government presented a number of proposals related to the legal technique, which were accepted.

The Deputy Minister of Justice Yeranuhi Tumanyants presented the positive opinion of the Government.

The co-rapporteur Artur Davtyan stressed the importance of the draft law, urging his colleagues to vote in favor of the initiative.

The Committee endorsed the draft law.
